How Illinois Defines Kidnapping

Under 720 ILCS 5/10-1, Illinois defines kidnapping in three distinct ways. A person commits the offense by knowingly and secretly confining another against their will, by carrying another from one place to another by force or threat of imminent force with intent to secretly confine that person, or by using deceit or enticement to induce another to go somewhere with that same intent.

Kidnapping: Class 2 Felony

Kidnapping under 720 ILCS 5/10-1 is a Class 2 felony, carrying a prison sentence of three to seven years. The charge is elevated to aggravated kidnapping under 720 ILCS 5/10-2, a Class X felony, when any of the following aggravating factors are present:

• Intent to obtain a ransom
• The victim is a child under 13 or a person with a severe or profound intellectual disability
• Great bodily harm (other than by the discharge of a firearm) or another felony is committed against the victim
• The offender conceals their identity
• The offense is committed while armed with a dangerous weapon other than a firearm
• The offense is committed while armed with a firearm
• The offender personally discharges a firearm
• The offender discharges a firearm causing great bodily harm, permanent disability, disfigurement, or death

Aggravated Kidnapping: Class X Felony

Aggravated kidnapping as a Class X felony carries a mandatory prison sentence of six to thirty years under 730 ILCS 5/5-4.5-25. Probation isn’t available. When a discharged firearm causes great bodily harm or death, an additional 25 years to natural life is added to the base sentence. A second or subsequent aggravated kidnapping conviction by an adult results in a mandatory natural life sentence. Class X felony convictions aren’t eligible for expungement or sealing under Illinois law.
